Tomasz has consistently represented borrowers in disputes with banks since 2009, specialising in cases involving unfair market practices and abusive clauses. He has a track record of several dozen final and binding court judgments, including cases concerning the recovery of overpaid interest on legacy-portfolio loans, low-equity insurance premium charges (UNWW), as well as rulings based on the invalidity or partial ineffectiveness of loans indexed or denominated in Swiss francs.
He has represented consumers before the Court of Competition and Consumer Protection, successfully obtaining final rulings declaring two variable-interest-rate clauses unlawful and having them entered in the register maintained by the President of the Office of Competition and Consumer Protection (UOKiK). He has also successfully appeared on behalf of borrowers before the Supreme Court.
He is co-author of two editions of the book "Przewodnik Frankowicza" (The Swiss Franc Borrower's Guide), published by Wolters Kluwer Polska — one of the most practical publications for CHF loan borrowers, their legal representatives and judges. He is a member of the Forum of Financial Lawyers.
